DEPORTATIONS: Biden is revoking one of Trump’s first executive orders, which declared that all of the roughly 11 million people in the country illegally are considered priorities for deportation. This is HUGE! TPS: To create an immediate pathway to green cards for beneficiaries of Temporary Protected Status (TPS). ENDING BAN ON MUSLIM TRAVELERS: Biden is ending the travel ban or the Muslim ban, one of the first acts of the Trump administration. A federal court has ordered the Department of Homeland Security to immediately resume accepting first-time DACA applications, AND travel permits (advance parole) for DACA holders. If you did not apply for DACA previously (for example, you did not meet the minimum 15-year-old requirement at the time the program was suspended), you should speak to a lawyer. Also, if you have a need to travel abroad and have DACA, or if you are a DACA holder who entered without inspection and is seeking an immigrant visa based on marriage, you should speak to a lawyer regarding new avenues this may open.

USCIS is experiencing delays in producing work permit cards after they have been approved. Temporarily, employees may use the original I-797C - Notice of Action (Approval Notice) to show employment authorization. Please note these details, however. The approval notice only proves employment authorization--not identity. A new employee can show an unexpired driver license or state ID to prove identity (a "List B" document) and the approval notice to show employment authoriza...tion (a "List C" document). Unfortunately, the license/state ID must not be expired. However, an AB60 license (non REAL ID) is valid for use for this purpose. If an employee is reverifying employment authorization with an employer, *it is not necessary to show a List B document*. An employer has already verified the identity of the employee using some other document. To re-verify employment authorization, the employer can accept just the List C document (approval notice). This may be helpful if the employee's license has expired on the same date as the EAD card. As a reminder, while EAD renewals are pending, employees who filed a timely renewal application can work for 6 months past their card's expiration date by showing their expired card and the receipt notice (refer to the language on the receipt notice). In California, people applying for U visas (like many of our clients), are eligible for many public benefits such as CalWORKS, Medi-Cal, IHSS (In Home Supportive Services), General Assistance, California Food Assistance Program (CFAP), Cash Assistance Program for Immigrants (CAPI), and State-Funded Refugee Cash for 8 Months. To apply, the applicant should take their U visa receipt (I-797, Notice of Action: Receipt Notice, for Form I-918 or I-918A). If already approved, take ...the Approval Notice or Category A19/A20 work permit. If you recently received a signed U visa certification and are preparing your application, you are also eligible under this California law, so long as you file your application within a reasonable time (in the opinion of our attorneys, 6 months). If your county social services agency is not aware of this program, refer them to "All County Letter 15-25" a copy can be downloaded at the link below.

Public charge rules do not apply to the receipt of unemployment compensation or paid sick leave. Immigrants with valid work permits (and who had valid work permits during the base quarter--two quarters ago) are eligible for unemployment compensation. Receipt of food stamps for your children will not cause a public charge problem. If received for one's citizen children, the benefit is not "received" by the parent.
