We are glad to have this first appellate win, and we are pleased to now be properly before the County Appellate Division on the merits. We feel strongly that Judge Guerrero’s order was necessary and properthis unlawful prosecution must be stopped! Dan Dow’s office cannot be trusted to prosecute any case involving Black Lives Matter because of his personal bias and racial-political animus. He is subservient to the more extreme and racist interests of the far right, and he sells his office to further their agenda. Any other prosecutorial agency would have apologized and dismissed this case long ago, or not even charged it in the first place.

In this Never Never Land (while the case is stalled under appeal), the defense should be able to get their discovery so they can move forward, Judge Duffy said, ordering the District Attorney’s Office to file its opposition to defense motions for sanctions by March 24. The defense does have a right to go forward with this motion. While the AG cowers behind his appeal, today the corrupt SLO DA tried to buy off 5 of the SLO 7 with offers of pre-trial diversion--essentially ...a offer of probation. After FABRICATING charges against my client and the others. After dragging their names through the mud for months. After they EXPOSED the DA for failing to prosecute the driver of a BMW who tried to kill BLM demonstrators with his car. After all that, the prosecution collapses--essentially admits the charges are a sham--and then asks these righteous demonstrators to take community service sentences? They did their community service on July 21, 2020! I am proud to see them still standing strong! SLO District Attorney Dan Dow's Office invidiously discriminated against my client and the other SLO 7 because of their emphatic belief that Black Lives Matter. Today, the Honorable Judge Matthew Guerrero granted our motion to disqualify Dan Dow and his O...ffice from prosecuting the case for his egregious conflicts of interest, and further ordered Murgia discovery of all internal evidence underlying the charging decisions in these cases. I am proud to have played a part in this decision, along with the other amazing attorneys on this case, both from my community of soul practitioners (Pier 5 Law Offices) and the local bar in SLO.

Anytime you build a better looking prison or jail, you're taking resources out of the community. The investment you're putting into the building of that infrastructure is investment you're not putting into reentry. You're not putting into educational programs and services. You know, we look to these prisons we see in Europe that are really beautiful and but they're built totally on a different system. They have very few people incarcerated. They have very low recidivism rates because they actually be-believe in repair like that these are citizens, and they're not based in slavery. Right? It didn't come from a system of enslavement.
