I've been asked, before, how many times a client gets a divorce. The vast majority of my clients only get ONE divorce. That's it. One client of mine had two divorces with the same woman and two separate child support actions regarding the children of the same woman. I represented another guy in two of his four divorces. I've had a few opposing parties who have as many as five children of different mates. But never, ever, in my career, have I handled the 5th divorce for ...anyone. It leads me to wonder what kind of personality does it take to get married 7 times in one lifetime. One might think the guy might have become an expert at prenuptial agreements. But one thing I have learned from years of experience. EVERY divorce involves unique facts and circumstances. EACH requires individual attention. EACH has a story, and EACH requires a custom-tailored set of solutions.

We all go into marriage to create a family that will last forever. And we really mean it, too. And while everybody knows it's best for children if their parents stay together, that is not the case when there is emotional toxicity in the home. The abused spouse who stays for benefit of the children ends up teaching the children either that it's okay to engage in abuse, or that it's okay to be abused without speaking up. Of COURSE it's best to stay together by FIXING these problems. Stay by all means -- but if staying really means hurting your kids, then you already know the right answer.

One time I had a case where two different men tested positive for paternity. But they could not both be the father of the same child. As it ultimately turned out, one of the tests was false. It *matters* which child you test. (!)

I word from the experts -- but I think much of this advice is impractical. Perhaps for high asset individuals, they insist upon prenuptial agreements. But for the rest of us, who go through marriage with every intention of doing the "not until death do we part," the community assets have to be disentangled upon divorce. An ounce of prevention is worth a pound of cure. It is best to get a legal consultation before getting married, and making clear decisions about the extent to which separate property gets commingled with the property of your spouse.
