We are losing Rule 1 365K LA County residents at risk of eviction. There are no moratoria. What is keeping tenants safe from eviction during the pandemic is Rule 1 from the State Judicial Council, a little-known body that administers the courts. Evictions can be filed. A summons won’t be issued. Without a summons the case can’t move forward unless the tenant files an Answer, bringing themselves under the power of the court. Rule 1 was enacted April 6 and was to expire 9...0 days after the Governor lifts the State of Emergency (current in effect until 9/30/2020 with the possibility of further extensions). On Friday 7/24/20 we learned the following from the Judicial Council Website. We our losing Rule 1. It was the tourniquet on the wound upon which our local officials placed a band aid while our state legislature and governor have stood around with their thumbs in their mouths. The Chief Justice is sending the legislative branch a clear message to take action and legislate a safety net for tenants. Please be attentive to action alerts next week. Those rules suspended court actions on evictions and judicial foreclosures during the COVID-19 pandemic.
