Are you responsible for taking care of your elderly parents? And maybe you feel like...you aren’t the right person for this? Some people aren’t meant to be caregivers, and THAT IS OKAY! .. If caregiving is... Stressing you out to the point of it affecting your mental health Compromising other areas in your life in a big way NOT your personality match . Then maybe it’s time to think about other ways to care for them besides caregiving. . One of the best ways to offer your care and love without being their caregiver? . Help them find the best option of caregiving where they will be taken care of most. . And remember, it’s okay. . Not everyone is meant to be a caregiver, and you can still love and care for your aging parents. If you want to chat give me a call. I speak with people on the phone at no charge to explain how I can help. Did a little reading today on what to expect after getting vaccinated. Biggest take away was not to let your guard down and continue to wear a mask and socially distance because one is not immune until about two weeks after getting the second dose. Since I will not even get the second dose until April 30 - my pilgrimage to Sedona for some MTB nirvana will be in Mid May! https://www.cnbc.com//fully-vaccinated-for-covid-what-you-

I have never had a client or family that wanted to be place or place a loved one into a nursing home. But the reality is that the vast majority of us, will need to spend some time in a nursing facility for rehabilitation purposes. If the medical condition that required rehabilitation is severe enough or if because of age or other factors one continues to require skilled nursing services to get better beyond the 100 days that Medicare will cover per year, it can become a very expensive proposition. The possibility of obtaining an additional 100 days of care covered by Medicare will be a godsend to those in this sort of situation. Understand however that there may still be fairly substantial co-pay depending on the whether one has obtained a Medicare supplemental policy. https://attorney.elderlawanswers.com//medicare-beneficiari

Anyone whom has had a loved one be admitted to a nursing home knows that it is essential to monitor the patients treatment. Nursing homes are understaffed and while the employees who provide the day to day care for a patient generally really care about their residents, there are often time not enough employees to meet the needs of each and every patient. One of the best ways to ensure that your loved one is receiving the care they require is to visit frequently. Finally some regulations are coming on line to prevent facilities from coming up with blanket policies preventing in person visitations without good cause. https://www.mcknights.com//nursing-homes-face-threats-of-/

So many things to consider when you are deciding when to take Social Security Benefits which can have a substantial effect on how much you and if your married, your spouse will receive as a monthly benefit. Highly recommended to consult with someone on the different considerations and while you are at it, making sure your estate planning documents are up to date! Do you have a loved one that has had a disability that prevents them from working and that existed before that person turned 26 years of age? Do you want to be able to financially help that loved one? Persons that are disabled often have to rely on means tested public benefits to help pay for their food, shelter, clothing and most importantly health care.... There are two main strategies that are best used together in this situation. The first is a Third Party Special Needs Trust; The second is an ABLE account. https://www.calable.ca.gov/ Both of these strategies allow funds to be held for the benefit of a person with disabilities and does not effect their ability to remain eligible for public benefits such as SSI, Medicaid, and Section 8. There are many nuances to creating a strategy to maximize the advantage and coordinate the use of both to maximize their benefit. Contact me if you want to learn more about these essential planning techniques.** *** Ethical rules require that I clearly indicate that this post is considered an attorney solicitation.

I spend a great deal of time drafting estate plans to avoid my clients and their families from having to go to court to settle an estate. I also spend a great deal of time in probate court where a person did not engage in adequate estate planning or heirs are fighting over a trust or estate. Every court process is somewhat complicated, laborious and time consuming. Due to Covid the court's budget like so many other government funded programs will be cut which will likely result in even longer delays in getting a case to court and resolving it

California courts are deciding how to determine damages for nursing home patients'. The discussion partly revolves around whether that should include a jury or not. https://news.bloomberglaw.com//california-justices-grapple

I attended a virtual town hall yesterday with about forty of my colleagues/members of the National Academy of Elder Law Attorneys from across the county. The topics of discussion revolved around Advance Health Care Directives in light of the CORONA-19 Pandemic. For years now I have helped my clients understand what sort of guidance or DIRECTION - they may want to consider including in their advance directives and providing numerous options in drafting these crucial documents. In light of the Pandemic - all of us may want to consider whether a DNR provision is appropriate or if they want to include specific direction on treatment i.e. oxygen therapy to intubation (ventialtion) to extracorporeal membrane oxygenation (ECMO).

During this Pandemic many of us are out of work or are not earning as much as we were and are forced to dip into our savings to pay for our mortgages, rent, food medical expenses etc. A little bit of relief is the fact that the Feds have lifted the regulation limiting withdrawals from savings account to 5 per month. https://www.cnn.com//fed-removes-savings-accoun/index.html
