The March 27, 2020 Coronavirus Aid, Relief, and Economic Security Act (CARES Act) was enacted to provide an estimated $2 trillion stimulus package to battle the effects of the COVID-19 pandemic on our economy. From that packag...e, at least $350 billion was earmarked to support small businesses to prevent layoffs and business closures. Distribution of these relief funds through the various national banks, has resulted in a hording of these funds by those more "favored" customers with the largest portfolios and daily deposits, leaving little or nothing for small business customers, thereby frustrating the very purpose of the CARES Act. While banks generally do not owe a "fiduciary duty" to its customers, there are exceptions, particular under the present set of circumstances.
