USCIS recently announced that it would be modifying policy relating to its premium processing services a service which allows for the expedited processing of visa and petitions for an additional fee, as part of new legislation introduced by Congress. On Thursday, October 1st U.S. District Judge Jeffrey S. White blocked the Trump administration from restricting new #H1B, #H2B, #L1, and #J1 visa restrictions, arguing that President Donald Trump exceeded his authority by implementing these restrictions. These visa restrictions were enacted by the Trump administration this past summer as a response to the COVID-19 pandemic, also known as the coronavirus. This ruling is in conflict with a conclusion reached by a federal judge in Washington, meaning that the constitutionality of these restrictions will likely be decided in an appeals court. "A federal judge granted a motion for a preliminary injunction against a far-reaching U.S. Citizenship and Immigration Services (USCIS) fee rule. The rule would increase fees on businesses, new citizens, international students needing work authorization and others. The fees were scheduled to go into effect on October 2, 2020." Given the various travel restrictions implemented worldwide in response to COVID-19, we wanted to share important information regarding reetry permits for green card holders and U.S. permanent residents who are planning on residing outside of the United States for an extended period of time. A lawful permanent resident (green card holder) may normally travel outside of the United States and return. However, there can be certain limitations that could pose problems for U.S.... permanent residents when trying to return to the United States. Your permanent resident card becomes technically invalid for reentry into the United States if you are absent from the U.S. for a year or more. Your U.S. permanent residence may be considered as abandoned for absences shorter than 1 year if you take up residence in another country. That's where a reentry permit can help you. A reentry permit establishes that you did not intend to abandon your green card status. It also allows you to apply for admission to the U.S. after traveling abroad for up to 2 years without having to obtain a returning resident visa. Reentry permits are normally valid for 2 years from the date of issuance. If you're planning on traveling outside the United States for an extended period of time, or do not wish to get a passport from your home country, a reentry permit could be your best option. Many countries allow for you to use your reentry permit much like you would use a passport. On Friday, September 11th 2020,U.S. Citizenship and Immigration Services announced that it was extending the flexibilities it announced on March 30, 2020, to assist applicants, petitioners, and requestors who are responding to certain: -Requests for Evidence; -Continuations to Request Evidence (N-14); -Notices of Intent to Deny;... -Notices of Intent to Revoke; -Notices of Intent to Rescind and Notices of Intent to Terminate regional investment centers; -Motions to Reopen an N-400 Pursuant to 8 CFR 335.5, -Receipt of Derogatory Information After Grant; -Filing date requirements for Form N-336, Request for a Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA); or -Filing date requirements for Form I-290B, Notice of Appeal or Motion. These flexibilities applies to the above documents if the issuance date listed on the request, notice, or decision is between March 1, 2020, and Jan. 1, 2021, inclusive.
