ANSWER ME THIS Today, if a loved one passes away without a Living Trust, their assets have to go through the court process of Probate before being distributed to their heirs. The filing fee for a Probate petition is nearly $500 in Los Angeles. However, after filing a Probate petition, the Executor is also required to publish a notice of the Probate in a local newspaper. These Publications of Probate can cost upwards of $400 themselves, even in very small newspapers with small... circulations. However, in these days of online media proliferation, actual newspapers are becoming obsolete. Very few people buy and read paper news anymore. So, is it fair for courts to continue imposing a $300 to $500 Publication fee on decedent's heirs? Does anyone still believe that a notice in a newspaper is even sufficient Publication of a Probate? What are the chances the right person will actually see the notice of Probate in a Newspaper? What if a $200 online Publication can actually reach more potential interested parties than in a newspaper? Should we change California law to give Executors more options, including less costly online choices, to publish notices of Probate?

The Supreme Court made two big 1st amendment rulings yesterday, in protection of speech and religion. 1) The Supremes ruled that *criminal prosecution of *online threats must meet the same higher "state of mind" requirements as other criminal speech trials. The court said that jury instructions lowering the mens rea standard to mere negligence, rather than recklessness or intentional, violated a man's 1st amendment rights to Post (seemingly threatening) remarks to his estr...anged wife on social media. The case was remanded to the trial court for revised jury instructions removing simply negligent mindsets. 2) The court also ruled that an employer could not discriminate against employment applicants based on religious head garb. A clothing retail store lowered a Muslim woman's employment hiring score after she arrived at her interview wearing a religious scarf or hijab. The Supremes said this point reduction violated the woman's 1st amendment religious rights. Very nice.

The USSC today overturned a GA man's aggrevated felony charges ruling that posession of 2 joints worth of MJ "does not even constitute a Federal midemeanor." Years ago, the man was pulled over for a moving violation when the police found a small amount of MJ in his car. The prosecutor charged him with an aggrevated felony in order to deport the father of 5. The man had been illegally emmigrated to the US at the age of 3. After FIVE years of exile in Jamaica, a country he had never known, he is expected to be allowed back into the US and finally see his wife and 5 children again. God bless America?

USSC ruled against unions today by stating that unions can no longer collect the political contribution portion of dues from (collectively bargained for) non-members unless those (union job benefiting) non-members specifically op-in to pay the political dues, with full disclosure. Corporations, however, are not required to ask shareholders or customers to opt-in to pay corporations' political contributions share, and nor are corporations required to disclose said contributions to shareholders or customers. How do you think this will effect unions' ability to make political or candidate contributions versus that of corporations?
