San Francisco can be considered the birthplace of California’s bail reform movement thanks to the case of Kenneth Humphrey. Humphrey was arrested in 2017 and charged with two felonies and two misdemeanors after allegedly robbing and threatening a 79-year-old man. When Humphrey was unable to secure his release, he later sued, arguing that California’s current bail system is discriminatory, which ultimately set in motion the passage of a new state law eliminating bail. That law now goes before voters this election for final approval in the form of Proposition 25. Ironically, Humphrey would not be released from jail if Proposition 25 was in place, yet he is featured in a recent TV commercial from Prop. 25’s proponents. What Californians must weigh when deciding on Prop. 25 is whether it improves fairness in our criminal justice system. The answer is overwhelmingly no, and that’s why voters must reject it.
