So much incorrect information circulating regarding CA's eviction moratorium. Gov. Newsom's Executive Order N-28-20 permits local municipalities to pass temporary ordinances regarding restricting evictions due to COVID-19 hardships. However, the ability to stop or delay rent payment due to COVID-19 is not automatic and is based on local municipality ordinances. Check your local government to determine the steps needed to properly protect yourself. Attached are pictures explaining San Diego's temporary ordinance (in English and Chinese). Check your local government for what ordinance applies.

Pro Tip (For business owners with commercial lease agreements) Check to see if your commercial lease has a "Force Majeure" clause (similar to the one in the picture). If there is, the provision may excuse the tenant from performing certain obligations under the lease because of government restrictions due to COVID-19. Usually, it doesn't excuse the tenant from having to pay rent on time (though I've seen language where it does allow the tenant to terminate or allow a temporarily rent abatement), but it may excuse the tenant from having to perform other obligations under the lease (maintain business hours, keeping a full staff, maintain insurance). Rent may be still due, but if the tenant does not have to perform other obligations, it may save on overall overhead.

If it passes it will solve some of these problems. This bill would increase the amount of liability insurance coverage an owner or operator of a motor vehicle is required to maintain to $30,000 for bodily injury or death of one person, $60,000 for bodily injury or death of all persons, and $25,000 for damage to the property of others as a result of any one accident.
