Do you ever come across a quote that sticks with you long after your've finished reading (or in this case hearing)? This is mine... What's YOUR Everest...? Boom! Something about this three worded question just really resonated with me so I grabbed a piece of paper that was nearby, wrote it down, and stuck it on my fridge a few weeks ago. (Bonus points if you recognize what is on the other side of this paper. ) It's one of the first things I read every morning and although I am still figuring out my answer, it helps me stay focused on the daily goals that will lead me to MY Everest one day. The San Bernardino Mountains need listings!!! For all my friends with cabins and homes up here , if you have been considering selling your place, trust me when I say, NOW is the time. ... PS. Make sure you use a local REALTOR!! I know you have friends down the hill that will do it for you but they don't know the ins and outs of mountain living like a local. Ask them what side of the street should the home be on for the best chance of the snow melting away in the morning? Or ask them to show you how to winterize a property? Or what are subterranean termites? Or where are the local flight paths? My favorite question to stump them is what's the difference between the lake at Arrowhead and the lake at Big Bear? You truly need someone who lives on the mountain to ensure you are in the best and most knowledgeable hands.

It's Title Terminology Thursday and we are talking about Sub-escrow, also known as loan payoffs. Ready... Set... Go A Sub-escrow (loan payoff) is an extremely important service provided by title companies to facilitate the handling of money in the closing of a real estate transaction. ... The performance of the Sub-escrow/Payoff function, exclusive of escrow services, is unique to Southern California (we are special ). No, really though, this is because a majority of our customers are independent escrow companies and the majority of our title orders require payoff services. Our Sub-escrow department does not draw escrow instructions or documents (i.e. Grant Deeds, Trust Deeds, etc.) and they do not order demands for Payoff. They simply take the funds from the buyer at the close of escrow and use them for payment of any obligations the seller may have (i.e. mortgage, liens, etc). When receiving quotes from escrow, you may see a fee on there called a "Sub-escrow fee" and your clients might ask you what exactly that is since they are already paying an escrow fee. This is generally a small fee charged to reimburse the title company for processing and disbursing these pay-offs and net proceeds. It's important to understand and be able to explain that an escrow and a sub-escrow are two different functions in the transaction. As always friends, I am here if you have any questions.

We all know that this is a fluid situation with changes happening what seems like daily but as of today, this is how business is being done.

This week I want to talk about the "Deed of Trust" (or also referred to as trust deeds). You will see these often on Preliminary Title Reports where any loans attached to the house have not been satisfied yet. If you do see this show-up, do not panic! These are common. Escrow will order a demand from the lender(s) which will allow the title company to pay off the existing loan(s) using proceeds from the new buyer’s loan (or proceeds if all cash). ... So, what exactly is a Deed of Trust? A Deed of Trust is a security instrument used by the borrower to convey "bare legal" title to the property, to a neutral 3rd party for the purpose of securing an obligation payable to the lender. "Bare legal" title means ownership without any of the benefits. I like to use the analogy of purchasing a vehicle with a loan to help explain this concept. Think about what happens when you buy a new vehicle using a loan. You own the car and get to enjoy the car but you do not get the actual pink slip until the loan is paid off. Then, when your obligation is satisfied (the loan is paid off), the lender sends the pink slip to you by mail (i.e. reconveys the title). So what happens when a Deed of Trust is paid off since we don't have pink slips for real property? Well, when the debt or obligation secured by a Deed of Trust has been satisfied, the beneficiary (lender) must execute a request for full reconveyance and any other documentation necessary to cause the Deed of Trust to be reconveyed and submit this documentation to the named Trustee. The trustee will then execute and record a "Full Reconveyance" in the county wherein the Deed of Trust was recorded. What you do need to watch out for is old trust deeds from previous owners (or sometimes the current owner if they have refinanced). If you find a trust deed listed that has already been paid, or that looks like it was taken out by a previous owner, call us or your escrow officer as soon as possible. How many of you noticed an increase in the cost to record a document starting just a few years back? CA SB-2 Building Homes and Jobs Act is the reason why! You will hear us in the title world refer to this as SB-2 Fees. Commencing January 1, 2018, in addition to any other recording fees, a $75 assessment shall be paid at the time of recording of every real estate instrument; which is described in the law as including but not limited to:... Deed Grant Deed Trustee’s Deed Deed of Trust Reconveyance Quitclaim Deed Fictitious Deed of Trust Assignment of Deed of Trust Request for Notice of Default Abstract of Judgement Subordination Agreement Declaration of Homestead Abandonment of Homestead Notice of Default Release or Discharge Easement Notice of Trustee Sale Notice of Completion UCC Financing Statement Mechanic’s Lien Maps Covenants, Conditions, and Restrictions The new law requires the county recorder to send revenues from this fee quarterly, after deduction of any actual and necessary administrative costs incurred by the county recorder, to the Controller for deposit in the Building Homes and Jobs Fund. The good news is that there are a few exceptions! The fee is not imposed on any real estate instrument, paper, or notice recorded in connection with a transfer subject to documentary transfer tax or in connection with a transfer of real property intended to be occupied by the owner. In other words, the documents recorded in connection with a sale transaction subject to documentary transfer tax are not subject to the $75 assessment (usually most resales will be exempt). In addition, a transfer NOT subject to transfer tax wherein the transferee/buyer will occupy the property as their residence is also not subject to the $75 assessment. (Transfer is the keyword here!!) Documents believed to be exempt from paying the fee must identify a valid exemption on the face of the document, or on a document cover page (San Bernardino County has one available on their website) when submitted for recording. If no valid exemption is declared, the fee may be assessed.
