Our big California Supreme Court case is finally going to be decided. The Court will release the opinion on Monday at 10 am. It’s going to be a nerve racking weekend! We have been on this legal journey for over five years!

Channel Law Group Argues Before California Supreme Court! After five years of litigation Jamie Hall and Julian Quattlebaum appeared before the high court in a case of great public importance. It was such an honor! The case name is Union of Medical Marijuana Patients v. City of San Diego. We represent the Union and are arguing that the enactment of a zoning ordinance permitting medial marijuana as a new use is subject to the California Environmental Quality Act.

Trying to help residents save more open space!

We won an environmental case today! This relates to a new freeway in Bakersfield dubbed the Centennial Corridor Project. The court ruled that CalTrans failed to make the findings required by the California Environmental Quality Act pertaining to biological resource impacts. One of the animals that will need to be protected is the San Joaquin Kit Fox, which is a special status species in California. The new freeway runs across 11 acres of the Kit Fox’s habitat. The court also ruled that Caltrans failed to adopt a Mitigation Monitoring and Reporting Program as required by law. We’ve now won three out of five CEQA cases brought in Kern County. Yippie!

When I am not practicing law, I'm often volunteering on behalf of my amazing community. I'm happy to report that the 2018 Laurel Canyon Association Annual Meeting was a success! Thank you to everyone that came out including Councilman David Ryu. Together, we can affect meaningful change. We’ve managed to buy five parcels in Laurel Canyon to date (over 17 acres). We are doing this to fight climate change, promote biodiversity, provide habitat for native flora and fauna, and protect the rural feel of Laurel Canyon. I hope we can look back in 10 years and take joy in what we’ve accomplished. But nothing happens without taking action! Let’s keep it up!

I'm happy to announce a new CEQA settlement! You may have heard about the controversy over the proposed demolition of Roosevelt High School in Boyle Heights - which is a historical resource where student walkouts occurred in 1968 that helped ignite the Chicano rights movement. After tense negotiations with LAUSD, including the Superintendent, an agreement was reached with our client, the Committee to Defend Roosevelt, that will create a new Social Justice Learning Center on the campus as well as the preservation of the entrance of the school as a monument. The District is committing millions of dollars toward this effort. Thank you to everyone involved in this effort. CLG endeavors to create positive outcomes even under the most trying circumstances.

I'm happy to report that CLG settled a CEQA case that I've been working on since 2014! Our client, First Free Will Baptist Church of Bakersfield, will receive approximately $500,000 from the California High Speed Rail Authority to pay for sound and noise mitigation improvements. California's proposed High Speed Rail is set to be located right next to the church and school.

So happy to announce the successful completion of our Let's Buy a Mountain campaign. As you may know, I am the President of my local neighborhood association, the Laurel Canyon Association. Together with Citizens for Los Angeles Wildlife and the Mountains Recreation and Conservation Authority, we raised $1.6 million to preserve 17 acres of open space in the Hollywood Hills. Remember that we are put on this earth to do good things - to leave it a better place. Find your mountain and climb it!

The Laurel Canyon Association in coordination with Citizens for Los Angeles Wildlife (CLAW) have entered into an agreement to purchase a sizable portion of the mountain above Wonderland School, between Lookout Mountain Avenue and Stanley Hills Drive. With your help, this very large piece of LA's greenbelt will be forever removed from the threat of development. This land will be maintained as open space by the Mountains Recreation & Conservation Authority in coordination with CLAW and the Laurel Canyon Land Trust. Channel Law Group is representing a group of residents who have challenged a condominium project alleging the project does not comply with the California Environmental Quality Act. The project would necessitate the demolition of apartment buildings that were constructed in the 1930s by one of the first female architects in Los Angeles! Interestingly, the apartment buildings scheduled for demolition are partly in the City of Beverly Hills and partly in the City of Los Angeles.... You could wake up in Beverly Hills and walk to your kitchen for coffee and be in Los Angeles. So strange... Jamie T. Hall of Channel Law Group represented a group of residents before the West LA Area Planning Commission on May 6, 2015. The residents had appealed the issuance of a Lot Line Adjustment for 10220 Scenario Lane on the grounds that the City did not conduct the required environmental review under the California Environmental Quality Act. In a rare victory, the commissioners decided to uphold the appeal and withdrew the Lot Line Adjustment. The developer was represente...d by noted land use attorney Ben Reznik. Staff stated at the hearing that granting the residents' appeal would be the first time in their memory that this had been done. In 2013, Jamie Hall represented SBA Communications in a case in Utah that was adjudicated by the Utah Property Rights Ombudsman. Advisory Opinion No. 125 was issued in favor of SBA, stating that a a collocation of equipment on a legal non-conforming wireless tower must be approved under the Middle Class Tax Relief and Job Creation Act of 2012.
