The fight for election integrity does not end here.
On March 3, 2010, the Patient Protection and Affordable Care Act of 2010 (ACA or Obamacare) was signed into law. The US Supreme Court (Nat’l Fed’n of Indep. Businesses v. Sebelius), upheld the personal mandate to buy health insurance pursuant to Congressional taxing authority. But the 2017 Trump tax cuts (The Tax Cuts and Jobs Act of 2017) removed the individual mandate effective this year. In December, a District Court in Texas stated that because the individual mand...ate is essential and unseverable from ACA, the ACA is unsustainable without the individual mandate. The coourt also notes that rewriting ACA without the individual mandate is beyond the power of his court. The US Attorney General defended the law in December. But Attorney General William Barr now is reversing course and has advised the appellate court that it now wants the appellate court to affirm the District Court judgment. The shift in legal position won’t make much of a difference in the lawsuit itself. Because a group of responsible states, including California, has intervened, the appeals court will hear a full-throated defense of the law. Most observers expect the court to uphold the Affordable Care Act; if so, the Supreme Court may choose not to hear the case. The irresponsibility of this new legal position is hard to overstate. It’s a shocking dereliction of the Justice Department’s duty, embraced by Republican and Democratic administrations alike, to defend acts of Congress if any plausible argument can be made in their defense. Dismantling the ACA would cause 2 million citizens to lose healthcare and cause chaos to the 156 Americans whose current policies include protections for preexisting conditions; cover preventive care and contraception without charge; changed how hospitals and physicians bill for their services; requires fast-food restaurants to post calorie counts; cut hundreds of billions of dollars of Medicare spending; imposed hundreds of billions of dollars in taxes; and much, much more. Or is this stunt a political attempt to "flip the script" from the news cycle criticizing Barr's coverup of the Mueller investigation report on the 2016 election and the Russion attack on our democracy?
