**********Case Update************* Barnes v. Target Corporation San Bernardino Superior Court Case No. CIVDS2007761 (and related to and apart of Ornelas v. Target Corporation)... PRELIMINARY APPROVAL OF CLASS AND PAGA REPRESENTATIVE ACTION SETTLEMENT OF $14 MILLION On January 5, 2021, the San Bernardino Superior Court, Hon. David S. Cohn, GRANTED plaintiffs' Motion for Preliminary Approval of Class Action Settlement in the amount of $14 million. See attached Order. Notice regarding the specific terms of the settlement and the individual settlement amounts to be paid to the approximate 9,200 class members will be sent to you on February 16, 2021. The individuals who are part of this proposed settlement include all Target DC nonexempt employees who worked at any of the seven California DCs from March 21, 2019 to January 5, 2021. A final approval hearing is set for May 21, 2021 at 10:00 a.m. in Department S-26 of the San Bernardino Superior Court, located at 247 West Third Street, San Bernardino, California 92415. **********Case Update************ Ornelas et al. v. Target Corporation United States District Court No.: 5:19-cv-01814-JVS-SP... On May 11, 2020, the Court determined that Target's use of AWS schedules (4x10 and 3x12) at T-553 (Fontana, CA) and T-555 (Woodland, CA) were unlawfully implemented, which would have required Target to pay DC employees overtime after 8 hours on every shift worked at those two locations for the period of March 21, 2019 to August 11, 2019 (a prior case, Loughrie, was resolved for the period prior to March 21, 2019 and California DC employees received compensation for that prior period in Loughrie). Thereafter, Target requested that the Court "reconsider" its prior ruling. The Court declined, and on June 22, 2020, the Court issued a second order reaffirming that Target's AWS elections at T-553 and T-555 were invalid, "as a matter of law." (See attached order from June 22, 2020.) Our firm has moved to certify the case representing ALL DC hourly employees for the period of March 21, 2019 to the present for all unpaid time. We believe that the same flaws at T-553 and T-555 were present at ALL DC locations throughout California. On September 14, 2020, the Court will decide if our firm can represent ALL DC hourly employees for every California location. If the Court certifies the class, we will be the attorneys for ALL California DC hourly employees for the period identified and will seek all unpaid wages, penalties, and interest that you are owed. To all 19 current and former employees of Marken who worked as drivers from June 11, 2018 to August 11, 2020, on August 11, 2020, the Los Angeles County Superior Court (Hon. Teresa A. Beaudet) granted Plaintiff's Motion for Approval of the PAGA Settlement. Distribution of PAGA Penalties to each of the aggrieved employees will take place within 60 days. Do you work a 4x10 or 3x12 schedule? Our firm is currently investigating employers who utilize 10 and 12 hour workshifts to insure that they are complying with California wage laws and orders. If you work at an employer utilizing a 10 or 12 hour work shift, we would like to speak with you.
