Someone cannot give consent if they are under the influence of alcohol or any other drug. This applies even if they verbally say "yes." Consent is as easy as F.R.I.E.S.: F: Freely Given- Consent should be made without pressure, force, manipulation or while drunk/high. R: Reversible- Anyone can change their mind, at any time I: Informed- Be honest. For example, if someone says they'll use a condom but they don't, that's not consent.
