It’s a common misconception that when you write an offer on a house, you lose your earnest money deposit if you back out. When you make an offer on a home, the BUYER has the right to cancel at any time, for any reason. If you withdrawal your offer, you do NOT lose your earnest money deposit. The only way you will lose this deposit is by backing out after you remove contingencies. Before removing contingencies, I always have a come-to-Jesus moment with my clients where I expla...in that this is the point of no return. If we back out of the deal after this decision of removing contingencies, we lose that deposit. It’s important to know these pivotal moments throughout the process. But what are contingencies? Contingencies are conditions or requirements that must be met before closing. They are walk-away clauses that allow you to back out if certain conditions are not met. Contingencies can be things like the pest inspection, appraisal, insurance, the sale of your current home, etc.
