Colula, has answered the weekly frequently asked immigration question: I entered the United States without authorization, but, since then, I traveled back to my home country with permission from the U.S. Citizenship and Immigration Services (USCIS) under my grant of Temporary Protected Status (TPS) or Deferred Action for Childhood Arrivals (DACA). Is my last entry with permission from USCIS considered a lawful admission for purposes of applying fo...r a green card? Yes. If you were granted TPS or DACA and travelled with permission from USCIS with what is known as advanced parole and you returned without any issues, then this last entry is considered a lawful admission and may make you eligible to apply for a green card assuming you have a qualifying relative and meet the rest of the requirements. Please contact our office to discuss your particular case to see if you may be eligible to apply for a green card. --- Entré a los Estados Unidos sin autorización (indocumentado), pero, desde entonces, viajé a mi país de origen con el permiso de los Servicios de Ciudadanía e Inmigración de los EE. Chuck Bonneau in our Sacramento office took some time to answer a frequently asked question regarding Immigration: Question: How long must a person who files for asylum in Immigration Court wait until they can apply for a work permit? Answer: The law and regulations on this particular issue are presently unclear. Until August 25, 2020, the asylum seeker would need to wait 180 days after filing for asylum in Immigration Court, before they could apply for a work permit with USC...IS. However, on August 25, 2020, the time period changed from 180 days, to 365 days. However, some people might still be able to file for a work permit after just 180 days, provided they belong to one of two Organizations: CASA de Maryland (CASA) and the Asylum Seeker Advocacy Project (ASAP). The law and regulations regarding immigrants’ and nonimmigrants’ right to work in the US is complicated and constantly changing.
