Attorney Luis Colula, of our Los Angeles office, answered this frequently asked question about immigration: After I have my Visa, will I be able to enter the United States? Maybe. A visa does not guarantee entry into the United States. A visa simply allows a foreign citizen to travel to the U.S. port-of-entry and the Department of Homeland Security U.S. Customs and Border Protection (CBP) decides whether to authorize or deny admission to the United States. Bakersfield based Partner Andrew Morgan has provide the Immigration Q&A this week. Is membership in the Communist Party or other totalitarian party grounds for inadmissibility to the United States? Yes. As of October 2, 2020, USCIS issued policy guidance on this issue. The USCIS Policy Manual to addresses the inadmissibility based on membership in or affiliation with the Communist Party or any other totalitarian party. It states that membership in or affiliation with the ...Communist Party or any other totalitarian party is inconsistent and incompatible with the Naturalization Oath of Allegiance to the United States of America because the oath includes pledging to support and defend the Constitution and laws of the United States. This new policy manual section provides applicants guidance on how to adjudicate inadmissibility due to membership in the Communist Party or any other totalitarian party in the context of adjustment of status applications. Further, according to USCIS the inadmissibility ground for membership in or affiliation with the Communist or any other totalitarian party is part of a broader set of laws passed by Congress to address security and safety threats to the United States. Generally, unless otherwise exempt, any immigrant who is or has been a member of or affiliated with the Communist or any other totalitarian party (or subdivision or affiliate), domestic or foreign, is inadmissible to the United States. It is important to understand that this ground of inadmissibility only applies to aliens seeking immigrant status, for example aliens inside the United States applying to adjust status to that of a lawful permanent resident. This area of the law is constantly changing. If you would like to learn more information regarding your specific circumstances, contact one our immigration attorneys. Modesto based Partner Claudia Aceves has answered the Q&A for Immigration this week. Q: Do I need to go through the entire application process to renew my non-immigrant visa? A: Yes, you will have to go through the entire visa application process every time that you want to apply for a visa, even if your visa is still valid. In some situations, a visa applicant may not have to be interviewed when renewing a non-immigrant visa. Also, some non-immigrant visas can be extended... (not renewed) by filing form I-539 with the USCIS. You should consult with one of our immigration attorneys to help determine the best path forward for your situation.
