As you learn more about how these trusts work, you may ask yourself What is a Special Needs Trust? A special needs trust is a type of legal document that allows parents to provide for their child's long-term care while still retaining control over funds during their lifetime. This will be especially helpful if the individual has disabilities or receives public benefits because it extends the time the funds will provide for their support. Having an SNT in place will provide ...funds to help with your child’s care, which might include medical treatments and therapies. The money you allocate will go into a trust during your lifetime, but it will not be used until after you have passed. This way, the individual with disabilities won't lose eligibility for government programs like Medicaid and Supplemental Security Income (SSI). #AdvocateFiduciaryServices #AdvocateFiduciary #FiduciaryServices

Once a conservatorship is established, can family members complain to the Court about things the Conservator is or is not doing? Family members absolutely have the right to complain to the court about a Conservator’s performance. There are several ways that family members can bring their concerns to the court’s attention. (1) As part of their annual review, the Court Investigator will speak to the family of a Conservatee to inquire if the family has any concerns (California P...robate Code Section 1851.1). If concerns are raised, the Court Investigator will include those concerns in their Report to the Court, which the court will review and take action on as the court determines appropriate (California Probate Code Section 1850). (2) In response to accountings and reports Conservators are required to file with the court, family members (and others) can bring their concerns to the court’s attention as part of the hearing on the Conservator’s accounting (California Probate Code Section 2622), or (3) family members (and others) can initiate a petition requesting that the court remove the conservator from their position as Conservator (California Probate Code Section 2651). #AdvocateFiduciaryServices #AdvocateFiduciary #FiduciaryServices

As much as you love your children and would like to think they will be caring and unselfish when you’re not there to referee, this is the time to be realistic. If they really don’t get along, or if there could be jealousies, you and your family will be much better off with a professional as your successor trustee. The fee they charge is a small price to pay if it keeps peace in your family. The purpose of this is to help you consider all the factors in choosing a responsible... person that will carry out your wishes without regard to family pressure and will carry out all tasks to the highest standards. Here is something to think about: - Do they WANT the responsibility? - At any time you choose, your Trustee can take over your bill-paying, arrange for additional help for you, and look after other responsibilities you designate. Trust administration can be time-consuming and fraught with difficulties. Financial transactions must be handled in a timely fashion. Beneficiaries must be kept informed to reduce fear and conflict. Decisions must be made and thoroughly documented (for as long as three years) after a loved one’s death. #AdvocateFiduciaryServices #AdvocateFiduciary #FiduciaryServices

Did you know when choosing a trustee it is important to choose someone who is financially responsible and has a solid character? Here are a couple of things to think about: Financially Responsible... - Do they pay their bills on time, have they had a bankruptcy, do they save money? Have A Solid Character - Are they honest when it comes to money? #AdvocateFiduciaryServices #AdvocateFiduciary #FiduciaryServices

Can a Professional Conservator pay themselves whatever they want from my assets? Conservators (whether Professional Conservators or family members or friends) cannot use the Conservatee’s assets to pay themselves unless and until the Court orders payment after a noticed Court hearing. (California Probate Code Section 2643.) All interested persons will have had a chance to review the request for Conservator’s fees and file objections for the Court to review. #AdvocateFiduciaryServices #AdvocateFiduciary #FiduciaryServices

Parents of children with special needs know that the future is full of uncertainty. You may find yourself worried about what will happen when they become an adult and you as the parent are no longer able to care for them. This is where a Special Needs Trust, or "SNT", comes in! What can be done if a Conservatee objects? If a Proposed Conservatee objects to the establishment of a Conservatorship, their appointed attorney is required to advise the court and advocate against the need for a Conservatorship. If the basis for the Proposed Conservatee’s objection is something other than the issue of their capacity, such as who should serve as Conservator, the court would likely make a decision after hearing from those that want to comment. But, if the Proposed Conservatee objects to the establishment of a Conservatorship because they do not believe they are unable to manage their affairs, the Proposed Conservatee would be entitled to a trial. #AdvocateFiduciaryServices #AdvocateFiduciary #FiduciaryServices
